Know this before the police arrive — BNSS §35(3)

For a cognizable offence punishable with imprisonment up to seven years, the police should ordinarily serve you a written notice to appear under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023 — arrest is the exception, not the first step. The Supreme Court confirmed this in Satender Kumar Antil v. CBI (order dated 15 January 2026), holding that the notice is mandatory and that any arrest instead requires reasons recorded in writing.

  • If you receive a §35(3) notice, attend and cooperate — complying ordinarily protects you from arrest for that offence.
  • Arrest after you have complied generally needs fresh material that the officer did not already have.
  • You have the right to know the grounds of arrest, to a lawyer of your choice, and to be produced before a magistrate within 24 hours.
  • Persons over 60 accused of offences punishable under three years have an extra safeguard under §35(7).
  • For offences punishable with more than seven years the notice-first rule does not apply the same way — anticipatory bail is usually the protection to seek.
