For a cognizable offence punishable with imprisonment up to seven years, the police should ordinarily serve you a written notice to appear under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023 — arrest is the exception, not the first step. The Supreme Court confirmed this in Satender Kumar Antil v. CBI (order dated 15 January 2026), holding that the notice is mandatory and that any arrest instead requires reasons recorded in writing.
